I. ACCEPTANCE OF TERMS OF USE AND OTHER POLICIES

a. All references to “You” or “Your” mean the person accessing, using, and/or participating in the FYAFIT Platform (“Users”). If you use the FYAFIT Platform on behalf of an entity, you represent and warrant that you have the authority to bind that entity.

b. Terms of Use: By accessing and using http://3.110.143.80 (Website) and/or FYAFIT application for mobile (APP), the user accepts and agrees to be bound by the terms and conditions of use. The website and the APP are collectively referred to as the “FYAFIT Platform.”

c. Privacy Policy: FYA has established a privacy policy that explains to Users how their information (“User Content”) is collected and stored. The Privacy Policy is referenced above and hereby incorporated into the Terms of Use.

d. Amendments to Terms of Use: The Terms of Use and any other document incorporated by reference are subject to modifications at any time. FYA reserves the right to modify or change these Terms of Use and other FYA policies at any time by posting changes on the domain of http://3.110.143.80/Terms.

I. ACCEPTANCE OF TERMS OF USE AND OTHER POLICIES

Membership eligibility criteria: To access and participate in certain features of the FYAFIT Platform, you will need to create a password-protected account (“Account”). Your use of the FYAFIT Platform and Services offered by the FYAFIT Platform must not violate any applicable law or regulation.

Use of the Platform: You agree that your use of the FYAFIT Platform shall be strictly governed by certain principles, including not hosting, displaying, or sharing information that belongs to another person without the right to do so.

III. TERMS OF SERVICE

You acknowledge and agree that FYA facilitates the hosting of services offered by third-party providers (“Service Provider”). FYA does not make warranties about the quality of services provided by the Service Providers.

IV. GENERAL TERMS OF USE

If you choose to use the FYAFIT Platform, you are responsible for maintaining the confidentiality of your account information. The FYAFIT Platform is intended for use within select cities in India, and users are responsible for compliance with applicable laws.

V. ACCESS TO THE PLATFORM, ACCURACY, AND SECURITY

We endeavor to make the FYAFIT Platform available 24/7 but do not guarantee uninterrupted access. We do not warrant the compatibility of the FYAFIT Platform with all hardware and software.

VI. RELATIONSHIP WITH OPERATORS IF THE PLATFORM IS ACCESSED ON MOBILE DEVICES

In the event the FYAFIT Platform is accessed on a mobile device, it is not associated with any operator, and your use is also bound by the terms and conditions of the Operator.

VII. DISCLAIMERS

The FYAFIT Platform may undergo constant upgrades, and information provided is “as is.” FYA disclaims liability for any unauthorized use of credit/debit cards. Users acknowledge the inherent risks in activities facilitated by the FYAFIT Platform.

VIII. BREACH OF TERMS

FYA has the right to terminate or deactivate your Account for any reason, without notice, if it believes you have violated any provision of the Terms of Use. Users indemnify FYA against losses arising from any breach.
